Elle offre (...) cependant, rapportée à d'autres intuitions philosophiques qui essaiment ailleurs dans l’œuvre de Goodman, une meilleure compréhension du fonctionnement des images.ABSTRACTIn this paper, I draw unexpected conclusions from Nelson Goodman's views on depiction. Faithful to the symbolic turn of aesthetics in the twentieth century, Goodman argues that pictures are as conventional and natural as scripts. Unlike scripts, however, pictures work in dense symbolic systems. The difference between image and script cannot be found where we would have spontaneously looked: in our perceptual experience of pictures. Obviously, the structural approach which is at stake in Languages of Art is iconoclast; we often consider it surprising, or even absolutely misleading, perhaps because we do not connect the analyses Goodman conducts in his essay with the experience we ordinarily have of pictures. I argue that Goodman's position becomes clearer when it is reduced to a much more modest philosophical purpose: to offer a criterion for discrimination between scripts and pictures. Pictures, unlike scripts, are dense. Of course, that does not explain depiction. However, my account of Goodman's view, when connected to intuitions about cognitive processes that have spread elsewhere in his work, sheds light on the way pictures are connected with the objects they depict. The concept of solidarity has recently come to prominence in the healthcare literature, addressing the motivation for taking seriously the shared vulnerabilities and medical needs of compatriots and for acting to help them meet these needs. In a recent book, Prainsack and Buyx take solidarity as a commitment to bear costs to assist others regarded as similar, with implications for governing health databases, personalized medicine, and organ donation. More broadly, solidarity has been understood normatively to call for ‘standing with’ or (...) assisting fellow community members and possibly also distant others in regard to their needs, whether for its own sake or in order to realize the demands of justice. I argue here that the understanding of solidarity in the existing bioethics literature is unduly restricted by not sufficiently theorizing the notion of structural (or systemic) injustice and its import for understanding solidarity. Extending traditional conceptions of labor and social movement solidarity, I contrast unitary solidarity within a given group with ‘networking solidarities’ across groups. I analyze the meaning of structural injustice and its significance for solidarity, including countering institutionally entrenched inequalities and economic exploitation. I then apply this broadened conception to healthcare, discussing structural problems with the U.S. insurance system and the solidarity movements addressing its deficiencies. I analyze some natural disasters and global health challenges that were aggravated by structural injustices, along with the solidarity movements they engendered. Finally, I revisit the questions of governing health databases and of personalized medicine with the enlarged conception of solidarity in view. (shrink)

Hailed as the most influential book ever written in favor of freedom, John Stuart Mill’s On Liberty is a contradictory and imprecise work. Mill’s notion of liberty coexists with anti-liberal ideas. He defended the private property of capitalists, but not of landowners. He criticized protectionism, but made an exception for infant industries. He defended competition, but set limits on it. He criticized general public education, but allowed the State to force citizens to study. He defended women and men’s freedom, but (...) not the freedom to choose the number of children they wanted to have, or decide about their education, or bequeath goods to them. He said parting from laissez faire was bad unless it produced some good. This admired friend of liberty could not find the logic in family, marriage, religion, tradition, morality, custom; he saw them only as repressive obstacles to freedom. A book supposedly upholding liberty ignores or disdains natural or pre-legal rights, and directs the bulk of its criticism not against the legal or political power of the State but against the tyranny of public opinion. Traditional conceptions of informed consent seem difficult or even impossible to apply to new technologies like biobanks, big data, or GMOs, where vast numbers of people are potentially affected, and where consequences and risks are indeterminate or even unforeseeable. Likewise, the principle has come under strain with the appropriation and monetisation of personal information on digital platforms. Over time, it has largely been reduced to bare assent to formalistic legal agreements. To address the current ineffectiveness of the norm of informed (...) consent, I suggest that we need a notion of structural injustice (on a distinctive interpretation, elaborated here, which takes account of unequal power and property relations). I then argue that in order to protect and enhance people's freedom, we have to go beyond traditional applied ethics and introduce perspectives from democratic theory and social philosophy. I attempt to show how applications of the ‘all‐affected principle’, together with new forms of democratic participation, deliberation, and representation can helpfully frame the narrower principle of informed consent. There is an important role for what we could call collective consent, and informed consent can only succeed in increasing individual agency if it is situated within enhanced forms of democratic decision‐making. This paper critiques Rothbard’s concept of gross investment. Rothbard introduced the concept in order to demonstrate his point that it is not consumer spending that primarily drives the economy, like the mainstream Keynesian view maintains, but the capitalists’ spending. In this paper, it is argued that, contrary to Rothbard’s opinion, the amount of gross investment as he defines it does not contain significant information concerning the question as to whether the capital structure of a society can be upheld or not. (...) Instead, it is an arbitrary figure that depends on the length of the different stages of production. This problem has not been recognized by Rothbard because his exposition rests upon the assumption of an equal time length for all stages. Apparently, he has been led astray by his intention to find arguments against the importance of consumer spending in the determination of output. (shrink)

This open access book presents an ethical approach to utilizing personal medical data. It features essays that combine academic argument with practical application of ethical principles. The contributors are experts in ethics and law. They address the challenges in the re-use of medical data of the deceased on a voluntary basis. This pioneering study looks at the many factors involved when individuals and organizations wish to share information for research, policy-making, and humanitarian purposes. Today, it is easy to donate blood (...) or even organs, but it is virtually impossible to donate one’s own medical data. This is seen as ethically unacceptable. Yet, data donation can greatly benefit the welfare of our societies. This collection provides timely interdisciplinary research on biomedical big data. Topics include the ethics of data donation, the legal and regulatory challenges, and the current and future collaborations. Readers will learn about the ethical and regulatory challenges associated with medical data donations. They will also better understand the special nature of using deceased data for research purposes with regard to ethical principles of autonomy, beneficence, and justice. In addition, the contributors identify the key governance issues of such a scheme. The essays also look at what we can learn in terms of best practice from existing medical data schemes. (shrink)

In eukaryotic cells intron sequences are usually spliced out with a high degree of precision from heterogenous nuclear RNA (hnRNA) to give functional mRNA with exons in their right order. Provided with the right substrates, cell extracts can achieve the same. With exotic substrates, on the other hand, the same extracts can cut exons from one RNA and join them to exons from another RNA, a process termed trans‐splicing. In vivo, RNA trans‐splicing could lead to faulty, but also to novel (...) proteins and, through reverse transcription, to genomic rearrangements. So far, in living cells trans‐splicing has only been invoked to occur in trypanosomes. In these unicellular organisms most if not all mRNAs are made discontinuously, so that the mature mRNAs carry, at their 5′ end, a common 35‐nucleotide sequence, called a miniexon, encoded separately in the genome. The miniexon is most likely joined to the body of the mRNA by trans‐splicing. (shrink)

Mathematics is often positioned as either neutral or non-neutral by mathematicians. However, in practice, issues of neutrality arise in situated contexts, and the positioning of mathematics as either neutral or non-neutral is done for many purposes. We interpret positioning of mathematical work, with different degrees of neutrality, as a response to conflicts of interest and power dynamics. Using a framework from ecofeminist critical theory, we examine the ways that mathematical neutrality is positioned and communicated to different audiences in ways that (...) can appear contradictory. Our goal is to demonstrate that the neutral/non-neutral dualism is insufficient for the analysis of neutrality in mathematics, which requires instead a robust analytical lens. We situate our discussion of these issues in the context of communication regarding the mathematical analysis of partisan gerrymandering in the United States. Through a study of communication to different audiences by mathematicians regarding mathematical techniques used to study partisan gerrymandering, we illustrate various ways in which dualistic views of neutrality are insufficient to describe and understand the complicated role of neutrality in this context. This paper investigates the import for a conception of democratic socialism of Marx’s well-known principle “From each according to their abilities, to each according to their needs,” arguing that it is best taken together with another of his principles: “The free development of each is the condition for the free development of all.” It considers their implications for the near term rather than some possible ultimate form of communal society, and also brings in a principle that I have developed previously—equal (...) positive freedom—which in some ways synthesizes the other two. In analyzing the abilities and needs principle, the notion and extent of needs are explicated, seeing them as including not only material needs, but needs for recognition and for relationships. Marx’s crucial insight that distribution largely depends on the organization of the production process also comes into play. On these bases, the paper proposes that a system of democratically managed firms forms the centerpiece for democratic socialism, supplemented by some other institutions that would work to meet basic needs. The paper also proposes a role for the norms of reciprocity and solidarity, in addition to those of freedom and equality that are most evident in the three principles. Finally, the relative inattention to social reproduction in the early Marxist tradition is addressed with an interpretation of the notion of socializing care and a consideration of its import for institutional design, including cooperative ways of providing such care. Throughout, Marx’s distinctive notions of social individuality, socialized wealth, and the free development of individuals are appealed to for the guidance they can provide for interpreting the abilities/needs principle for the period ahead. The boundaries between medicine, religion, nursing and domestic service were fluid in mid‐nineteenth‐century England. The traditional religious understanding of illness conflicted with the newer understanding of anatomically based disease, the Anglican sisters were drawing a line between professional nursing and the traditional role of nurses as domestic servants who looked after sick people as one of their many duties, and doctors were looking for more knowledgeable nurses who could carry out their orders competently. This prosopographical study of the over 200 (...) women who served as government nurses during the Crimean War 1854–56 describes the status of nursing and provides a picture of the religious and social structure of Britain in the 1850s. It also illustrates how religious, political and social factors affected the development of the new nursing. The Crimean War nurses can be divided into four major groups: volunteer secular ladies, Roman Catholic nuns, Anglican sisters and working‐class hospital nurses. Of these four groups I conclude that it was the experienced working‐class nurses who had the greatest influence on the organization of the new nursing. (shrink)

Thus, observation ofapparently gratuitous evil is not evidence foror against either hypothesis. In the absenceof any other evidence for or against theism,the most reasonable position is agnosticism.

A common early narrative that arose as people struggled to cope with their new lives under COVID-19 centered on a platitude about the pandemic being “the great leveler.” But the pretense that we are equally vulnerable—or that we’re “alone together” across lines of race, gender, and class—was a comforting lie. Chronicling the timeline of media talking points seen over the past few months, I argue that social privilege continues to structure the narratives many people use to process life under the (...) pandemic, even while material conditions are much worse for those not in charge of these narratives. At the same time, however, I argue that the pandemic might be setting the stage for genuinely new collective responses to social inequalities, including the long-overdue uprisings inspired by the Black Lives Matter movement.
